Competition Law | Update of the “Mobile Unit” Value | Resolution No. 6/2026

On January 16, 2026, Resolution No. 6/2026 issued by the National Competition Authority (the “Authority”) was published in the Official Gazette. Through this resolution, the Authority updated the value of the Mobile Unit (Unidad Móvil), setting it at ARS 1,450.05 (one thousand four hundred fifty pesos and five cents).

The Mobile Unit is a unit of account created by Competition Law No. 27,442 and is used, among other purposes, to determine the turnover thresholds triggering the obligation to notify economic concentration transactions, the exceptions to such obligation, the filing fees applicable to the notification process, as well as fines for anticompetitive conduct and daily penalties for non-compliance where such sanctions cannot be determined under the parameters set forth in the law.

Section 85 of Law No. 27,442 established the initial value of the Mobile Unit at ARS 20 and provided for its automatic annual adjustment in accordance with the variation of the Consumer Price Index (CPI) published by the National Institute of Statistics and Census (INDEC). The law further provides that such update shall be calculated as of the last business day of each year and shall become effective upon its publication.

Within this framework, and following the establishment and commencement of operations of the National Competition Authority and the Competition Tribunal pursuant to Decrees No. 803/2025 and 810/2025, the Tribunal issued Resolution No. 6/2026 establishing the value of the Mobile Unit for the year 2026 at ARS 1,450.05 (one thousand four hundred fifty pesos and five cents), based on the accumulated CPI variation for the 2025 calendar year. This represents a significant increase compared to the value in force in 2025, which amounted to ARS 1,102.28.

Based on this updated value, the main thresholds established under Law No. 27,442 are as follows:

Turnover threshold triggering the obligation to notify economic concentrations:
100,000,000 Mobile Units, equivalent to ARS 145,005,000,000.

Exception to the obligation to notify an economic concentration based on the value of the transferred assets and the transaction price:
20,000,000 Mobile Units, equivalent to ARS 29,001,000,000.

Exception to the obligation to notify an economic concentration based on the aggregate value of assets and transaction prices of transactions carried out during the previous thirty-six (36) months:
60,000,000 Mobile Units, equivalent to ARS 87,003,000,000.

Filing fee applicable to economic concentration notification proceedings (not yet in force):
Between 5,000 and 20,000 Mobile Units, equivalent to between ARS 7,250,250 and ARS 29,001,000.

Fine for anticompetitive conduct where it cannot be determined in accordance with the parameters set forth in the Law:
Up to 200,000,000 Mobile Units, equivalent to up to ARS 290,010,000,000.

Daily penalty for failure to notify an economic concentration, non-compliance with conditions or cease-and-desist orders, where the sanction cannot be determined under the parameters set forth in the Law:
Up to 750,000 Mobile Units, equivalent to ARS 1,087,537,500.

Daily penalty for obstruction of investigations or failure to comply with requests within the applicable deadlines and in the required form:
500 Mobile Units, equivalent to ARS 725,025.
